Below is a list of goods whose import into Vietnam requires a license, categorized by their managing ministry.

I. Goods Managed by the Ministry of Industry and Trade (MOIT)

  1. Line guns.
  2. Goods subject to import control as regulated by international treaties to which Vietnam is a signatory, as announced by the Ministry of Industry and Trade from time to time.
  3. Goods subject to the automatic import license regime: The Ministry of Industry and Trade announces the list of these goods from time to time and organizes the issuance of licenses in accordance with current licensing regulations.
  4. Goods subject to a tariff quota regime:
    • Salt
    • Raw tobacco
    • Poultry eggs
    • Refined sugar, raw sugar The Ministry of Industry and Trade specifies the HS codes for these goods in the Import and Export Tariff Schedule.
  5. Chemicals and chemical-containing products:
    • Group 2 chemicals and Group 3 chemicals (according to Appendix 1 of Decree No. 100/2005/ND-CP).
    • Precursors used in industry (according to the Law on Drug Prevention and Control and its guiding documents).
  6. Explosive precursors and industrial explosive materials.
  7. Tobacco raw materials, tobacco products, cigarette rolling paper; specialized machinery and equipment for tobacco production and their spare parts.

II. Goods Subject to Specialized Management by the Ministry of Transport (MOT)

  1. Various signal flares for maritime safety. (The Ministry of Transport announces the list with correct HS codes in the Import and Export Tariff Schedule).

III. Goods Subject to Specialized Management by the Ministry of Agriculture and Rural Development (MARD)

  1. Veterinary medicines and raw materials for their production, registered for the first time for import into Vietnam.
  2. Biological products, microbiological products, and chemicals used in veterinary medicine, registered for the first time for import into Vietnam.
  3. Plant protection products and raw materials for their production that are not on the list of products permitted for use in Vietnam. Plant protection products and raw materials on the list of restricted-use products.
  4. Animal breeds not on the list of breeds permitted for production and trade in Vietnam; various insects not yet present in Vietnam; semen and embryos of animal breeds imported for the first time into Vietnam.
  5. Plant varieties and living organisms in the field of plant protection, and other items on the list of objects subject to plant quarantine that must undergo pest risk analysis before being imported into Vietnam.
  6. Plant varieties not on the list of varieties permitted for production and trade in Vietnam, imported for research, trial production, international cooperation, as samples for exhibitions, as gifts, or to implement investment programs and projects.
  7. Animal feed and raw materials for animal feed production; aquatic feed and raw materials for aquatic feed production not on the list of products permitted for circulation in Vietnam.
  8. Fertilizers not on the list of products permitted for production, trade, and use in Vietnam.
  9. Genetic resources of plants, animals, and microorganisms for research and scientific and technical exchange.
  10. Wild animals and plants that require import control as stipulated by the CITES Convention, which Vietnam has committed to implementing.
  11. Raw materials for producing biological products, microbiological products, chemicals, and environmental treatment substances for aquaculture. Finished products on the list of products permitted for circulation in Vietnam or on the list of conditionally imported products. Finished products not yet named on the list of products permitted for circulation in Vietnam or on the list of conditionally imported products.
  12. Aquatic breeds that are normally imported. Conditionally imported aquatic breeds. Aquatic breeds not on the list of normally permitted imports for the first time into Vietnam.
  13. Live aquatic products for food on the list of products that are normally imported. Live aquatic products for food that are not on the list of live aquatic species permitted for import for food in Vietnam.

IV. Goods Subject to Specialized Management by the Ministry of Natural Resources and Environment (MONRE)

  1. Scrap materials.

V. Goods Subject to Specialized Management by the Ministry of Information and Communications (MIC)

  1. Various types of publications (books, newspapers, magazines, paintings, photos, calendars).
  2. Postage stamps, stamp publications, and other stamp-related items.
  3. Microwave equipment and radio transmission/reception equipment with a frequency band between 9KHz and 400 GHz and a power output of 60mW or more.
  4. Specialized prepress and typesetting systems for the printing industry.
  5. Various types of printing machines (offset, Flexo, rotogravure) and color photocopiers.

VI. Goods Subject to Specialized Management by the Ministry of Culture, Sports and Tourism (MOCST)

  1. Cinematographic works and other audiovisual products recorded on any material.
  2. Plastic arts, applied arts, paintings, and photographs.
  3. Video game machines with prize-awarding programs and specialized equipment for casino games.
  4. Children’s toys.

VII. Goods Subject to Specialized Management by the Ministry of Health (MOH)

  1. Narcotic drugs, psychotropic drugs, precursors for medicinal use, and radiopharmaceuticals (including finished products in single-ingredient or combined form).
  2. Finished drugs for human disease prevention and treatment that have been issued a registration number.
  3. Finished drugs for human disease prevention and treatment that have not been issued a registration number.
  4. Raw materials for drug production, medicinal materials, excipients, drug capsules, and direct drug-contact packaging materials, newly used in Vietnam.
  5. Cosmetics that directly affect human health.
  6. Vaccines and medical biological products without a registration number.
  7. Medical equipment with the potential to directly affect human health, not on the list of imported goods that can be imported based on demand.
  8. Chemicals and preparations for insect and bacteria control used in household and medical fields.
  9. Chemicals and preparations for insect and bacteria control used in household and medical fields that have not been granted a registration certificate for circulation in Vietnam.
  10. Cosmetics that have not been issued a declaration receipt number, imported for research or testing purposes.

VIII. Goods Subject to Specialized Management by the State Bank of Vietnam (SBV)

  1. Metal blanks used for minting and stamping coins.
  2. Vault doors (according to technical standards regulated by the State Bank of Vietnam).
  3. Banknote paper.
  4. Banknote ink.
  5. Anti-counterfeiting blank presses and anti-counterfeiting blanks for use on banknotes, bank drafts, and other valuable documents and papers issued and managed by the Banking sector.
  6. Banknote printing machines (according to technical standards announced by the State Bank of Vietnam).
  7. Coin minting and stamping machines (according to technical standards announced by the State Bank of Vietnam).

IX. Goods Subject to Specialized Management by the Ministry of National Defense (MOD)

  1. Motor vehicles for transporting 10 or more people, including the driver (Armored types without military weapons, excluding CKD form).
  2. Motor vehicles and other motor vehicles primarily designed for transporting people (excluding those in group 87.02), including station wagons and racing cars (Armored types without military weapons, excluding CKD form).
  3. Motor vehicles for transporting goods (Armored types without military weapons, excluding CKD form).
  4. Other flying vehicles (e.g., helicopters, airplanes); spacecraft (including satellites) and orbital spacecraft, and launchers for spacecraft (Only applies to airplanes and helicopters not used in civil aviation and not equipped with combat gear-weapons).
  5. Other weapons (e.g., spring-powered, air, or gas guns and pistols, batons), except for those in group 93.07.
  6. Other types (paintball guns, paintball pistols, line-throwing guns).
  7. Colorants for art, school, or sign painting; prepared pigments, opacifiers, and similar colors in tablets, tubes, jars, bottles, palettes, or similar forms or packaging.
  8. Other types (paintballs).

1. Customs Procedures for Imports

1.1. Preparation: Gather the following documents for customs declaration:

  • Import permit (if the goods require a license for import)
  • Commercial Invoice
  • Packing List
  • Bill of Lading
  • Certificate of Origin (C/O)
  • Fumigation Certificate and Phytosanitary Certificate (if applicable)
  • Certificate of Analysis (C/A)
  • Certificate of Quality (C/Q) (if applicable)

1.2. The Process

Step 1: Declare Import Information (IDA) The customs declarant uses the IDA operation to declare import information before registering the customs declaration form.

After all 133 fields on the IDA screen are filled, the declarant sends the data to the VNACCS system. The system automatically assigns a number, populates fields related to tax rates and corresponding names (for example: the name of the importing country corresponding to the country code, the name of the importing company corresponding to the enterprise code, etc.), and automatically calculates values related to customs value and taxes.

The system then sends a response back to the declarant on the declaration registration screen (IDC). Once the system assigns a number, the IDA import information form is saved on the VNACCS system.

Step 2: Register the Import Declaration Form (IDC) Upon receiving the IDC screen from the system, the customs declarant checks the declared information and the automatically populated and calculated data. If the information is confirmed to be accurate, it is sent to the system to register the declaration.

If, after checking, the declarant finds that the information is inaccurate and needs to be amended, they must use the IDB operation to recall the IDA import information screen, make the necessary corrections, and follow the same steps as above.

Step 3: Check Conditions for Declaration Registration Before allowing a declaration to be registered, the system automatically checks the list of enterprises ineligible for declaration registration (e.g., businesses with overdue debts over 90 days, those that are temporarily suspended, dissolved, or bankrupt).

For declarations in the Green Channel:

  • If the tax payable is zero: The system automatically grants customs clearance (expected to take 3 seconds) and issues an “Imported Goods Customs Clearance Decision” to the declarant.
  • If the tax payable is not zero:
    • If the tax is declared to be paid by a credit limit or via a guarantee (general or specific): The system automatically checks the declared information related to the limit or guarantee. If the amount is greater than or equal to the tax payable, the system will issue a “Document Noting Tax Payable” and an “Imported Goods Customs Clearance Decision” to the declarant. If the amount is less than the tax payable, the system will report an error.
    • If tax is declared to be paid immediately (bank transfer, cash at the customs office, etc.): The system issues a “Document Noting Tax Payable” to the declarant. Once the customs declarant has paid the taxes, fees, and charges, and the VNACCS system has received the payment information, the system issues a “Goods Customs Clearance Decision.” At the end of the day, the VNACCS system compiles all cleared Green Channel declarations and transfers them to the VCIS system.

For declarations in the Yellow and Red Channels: The system transfers the data of Yellow and Red Channel declarations online from VNACCS to VCIS. After the customs authority performs checks and processes the declaration on the VCIS system screen, using CKO or CEA operations to complete or provide guidance, the customs declarant must take the following steps:

  • Receive the system’s response regarding the channeling result, location, and type/level of physical inspection of the goods.
  • Submit the paper documents for the customs authority to conduct a detailed review; prepare the goods for physical inspection.
  • Fulfill all tax and fee obligations (if any).

Step 5: Amending and Supplementing Declarations During Clearance The system allows for amendments and supplements to the declaration from the time it is registered until the goods are cleared.

To perform an amendment or supplement during clearance, the customs declarant uses the IDD operation to recall the full import declaration information screen (IDA) for the first amendment, or the most recent amended import information (IDA01) for the second amendment or subsequent ones.

2. Customs Procedures for Exports

2.1. An Overview of Export Customs Procedures

The steps for export customs procedures are quite similar to those for imports. To proceed with customs formalities for exports, businesses need to follow the steps below.

2.2. The Process

Step 1: Declare Export Information (EDA) The customs declarant uses the EDA operation to declare export information before registering the export declaration form.

After all 109 fields on the EDA screen are filled, the declarant sends the data to the VNACCS system. The system automatically assigns a number, populates fields related to tax rates and corresponding names (for example: the name of the destination country corresponding to the country code, the name of the exporting company corresponding to the enterprise code, etc.), and automatically calculates values related to customs value and taxes.

The system then sends a response back to the declarant on the declaration registration screen (EDC). Once the system assigns a number, the EDA export information form is saved on the VNACCS system.

Step 2: Register the Export Declaration Form (EDC) Upon receiving the EDC screen from the system, the customs declarant checks the declared information and the automatically populated and calculated data. If the information is confirmed to be accurate, it is sent to the system to register the declaration.

If, after checking, the declarant finds that the information is inaccurate and needs to be amended, they must use the EDB operation to recall the EDA export information screen, make the necessary corrections, and follow the same steps as above.

Step 3: Check Conditions for Declaration Registration Before allowing a declaration to be registered, the system automatically checks the list of enterprises ineligible for declaration registration (e.g., businesses with overdue debts over 90 days, those that are temporarily suspended, dissolved, or bankrupt).

If the enterprise is on the aforementioned list, the declaration cannot be registered, and the system will notify the customs declarant.

  • The beneficiary is the buyer at the port of destination.
  • The relevant Incoterms for sea transport insurance are CIP and CIF.
  • The insurance conditions are ICC A, B, or C.
  • The insurance premium is approximately 0.06% to 0.075% of the insured value.
  • The insured value can be the FOB or CIF price.
  • All regulations related to liability and exemption clauses are specified in the Institute Cargo Clauses (ICC) 2009.

The Claim Process:

  1. The insured party notifies the policyholder of the cargo loss.

Domestic individuals and organizations entrusting import procedures to another organization must ensure that the entrusted organization meets the requirements for a customs declarant, as stipulated in Article 5 of Decree 08/2015/ND-CP dated January 21, 2015, which was amended and supplemented by Clause 3, Article 1 of Decree 59/2018/ND-CP dated April 20, 2018, of the Government.

Customs procedures are to be carried out in accordance with Circular 38/2015/TT-BTC dated March 25, 2015, and Circular 39/2018/TT-BTC dated April 20, 2018, of the Ministry of Finance.

  • Verify the capacity and familiarity of the entrusted company with entrusted import procedures.
  • Sign a consignment agreement for the imported goods.

7. Legal Considerations for Entrusted Imports

7.1. On the Entrusted Import/Export Contract

The entrusted import contract is a service agreement. Therefore, the contract will contain key terms related to the service scope, costs, rights and obligations of the parties, and payment.

The entrusted import/export contract must align with the underlying import/export contract to prevent potential disputes or complications.

The determination of the commission fee in this contract also needs to be clearly defined. Typically, the commission amount is determined by the value of the consignment and the specific goods.

Furthermore, the obligations of each party should be clearly stated in the contract.

7.2. Responsibilities of the Entrusted Business

  • Negotiate and sign the international trade contract with the foreign seller.
  • Carry out all necessary procedures for importing or exporting the products.
  • Handle payments to international suppliers.
  • The service provider is referred to as the consignee. For manufactured goods, they must ensure the preparation of paperwork, declaration, and payment of various taxes such as import duties, special consumption tax, and VAT on imported goods (based on the tax notice from the customs authority).
  • Maintain all import/export paperwork, including:
    • Consignment transactions
    • Commercial Contract negotiated with the foreign party
    • Commercial Invoice issued by the seller
    • Packing List issued by the seller
    • Customs declarations, tax receipts (if any), and Bill of Lading issued by the carrier (ship, airplane, etc.).

When returning the imported goods to the owner (the consignor), the consignee must issue a VAT invoice for the consignment. The invoice must clearly state the total payment to the consignor, which includes the purchase price (on the commercial invoice), amounts, import duties, special consumption tax, and VAT on imported goods (according to the customs tax notice). This entrusted import invoice is used to calculate the consignee’s production tax and the consignor’s input tax.

7.3. Responsibilities of the Entrusting Business

  • Provide the consignee with full details on the product type, standards, dimensions, etc.
  • Negotiate an agreement with the international partner in collaboration with the entrusted business.
  • Transfer payment for the goods to the entrusted business, which will then pay the supplier.
  • Arrange for the transportation of goods.
  • Pay the insurance fee for the entrusted operation.

8. Risks in the Entrusted Import & Export Process
